NMA Statement on Cross-State Ruling

National Mining Association (NMA) President and CEO Hal Quinn issued this statement following today’s 6-2 Supreme Court ruling upholding the Environmental Protection Agency’s (EPA) Cross-State Air Pollution Rule:


“As a party to these proceedings, we are disappointed in the outcome and gravely concerned with the latitude afforded EPA to preempt states before they have had a reasonable chance to act. Today’s decision appears to sanction EPA’s subversion of the primary responsibility Congress delegated to the states under the Clean Air Act. States, and the businesses operating within those states, cannot be expected to anticipate and conform to standards EPA had yet to announce. Moving regulatory targets and changing regulatory interpretations are the enemies of investment and job creation.”
